(3) For purposes of paragraph (a)(2) of this section, an election to be treated as a “preserve and defer” IRA plans under section 408(a) does not require that the plan be treated as a defined benefit plan. (4) The following rules apply to an employer made “preserve and defer” status under section 408(a): (i) To the extent such election is made on a calendar quarter basis for compensation in excess of 10,000, the employer is treated as having elects to treat all or part of each month of the quarter as compensation.
